Terms & Conditions

These are the terms and conditions that apply in relation to our boat trips. They should be read in conjunction with our boat trip page which provides further details in relation to clothing, safety and other important aspects of your boat trip. 

Please read these terms carefully before you submit your booking. 

Introduction 
Your contract is with the Port of Milford Haven. Your contract incorporates these terms and by making a booking with us you confirm your acceptance to these terms. 

Suitability and Accessibility
These boat trips are only suitable for passengers aged 5 and over, with suitable mobility to be able to embark and disembark safely. The skipper and crew will oversee the process of embarkation and disembarkation and offer assistance where possible, to ensure a safe and enjoyable experience aboard.

Purchasing of tickets
Tickets can be purchased by the following means:

(a)    Online by visiting our website www.coastandcleddau.co.uk; or
(b)    By calling 01646 696370; or
(c)    By paying the boat skipper in cash or by card at Mackerel Quay (we would advise you contacting us in advance to check availability, and would recommend booking online or by telephone prior to arrival, to avoid disappointment). 

When you make a booking and pay, we will reserve a place on the vessel on the basis of these terms and conditions. 

Your booking will be taken as confirmed in respect of all persons named on your booking and a binding contract between us will come into existence upon:

(a)    Our sending of your booking confirmation if booking online; or
(b)    The issue of tickets. 

Price 
The price of the boat trip (which includes VAT) will be the price indicated to you on the telephone, by email, or online. 

We accept payment by cash or all major credit and debit cards.

We reserve the right to alter prices shown in promotional literature or online. From time to time we offer special offers on our boat trips. 

Cancellation by you
Unfortunately we do not offer refunds if you cancel, but we will use our best endeavours to find a boat trip on an alternative date.

Cancellation by us 
In certain circumstances it may be necessary to cancel a boat trip due to reasons which are beyond our control (such as inclement weather or due to instructions from an operator that it is too unsafe to proceed with the boat trip). In the event that we need to cancel a boat trip, we will provide you with the following alternatives:

(a)    book a boat trip at an alternative date/time at no additional cost; or 
(b)    have a full refund. 

Your responsibilities 

(a)    Medical conditions
When booking you must inform us of any medical conditions or disability (including but not limited to pregnancy, back injuries or bone or heart conditions) that may affect you whilst on a boat trip. Passengers with any reduced mobility must provide full details at the time of booking. It is important that you provide this information to us so that we can ensure the safety of all passengers, the crew and the vessel. It is your responsibility to ensure that you are physically able to embark and disembark the vessel before making a booking. Please note that due to the size of the vessel, we are limited for space to take wheelchairs and other mobility aids onboard, but will do our best to accommodate (please let us know in advance if you or any of your party rely on a mobility aid at time of booking, and would like to bring these items on the boat trip). If you do not provide full details of your medical problems or disability at the time of booking, we reserve the right to cancel your booking if in our reasonable opinion we do not think that the boat trip is suitable for you.

(b)    Behaviour
You are responsible for conducting yourself, and others in your party, properly whilst onboard the vessel.  We reserve the right to refuse you or a member of your party onto the vessel if, in our reasonable opinion, you are behaving unacceptably or that you under the influence of alcohol and/or drugs. We will not pay any refund, compensation or any other monies if we decide not to allow you or others in your party on board due to unacceptable behaviour. The skipper’s decision is final.

(c)    Personal possessions 
You are responsible for any loss or damage caused by you or your personal possessions during your boat trip to any property, person, third party or to us, no matter how that loss is caused. We reserve the right to demand immediate reimbursement/compensation for any loss or damage caused by you.  

(d)    Time keeping
You are responsible for ensuring that you arrive at the departure point (confirmed at time of booking) in advance of the commencement of the boat trip. In the event that you arrive late and the boat trip is underway, you will not be entitled to any refund.


Safety and conduct

You are responsible for your safety onboard the vessel at all times, including embarking and disembarking.  The skipper of the vessel and his/her crew are in sole charge and you should adhere to any instructions that they may give throughout the boat trip. Seat belts must be worn inside at all times due to changing sea conditions, and life jackets provided must be worn when the vessel is stationary and passengers are safely able to go outside onto the sun deck at a point of interest, under the supervision of the skipper and crew. 

No animals, dangerous articles, or controlled or prohibited substances may be brought onto the vessel. Assistance dogs are permitted on board, but must be fitted with floatation safety equipment (not supplied) – we must be notified of this at time of booking.

If you or any of your party experience illness whilst onboard, one of our crew will assess you, and a decision will be made as to whether the vessel should be brought back to shore for you or a member of your party to seek medical assistance. 

Our responsibilities for loss suffered by you.
We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. However we will not be liable where any failure in the performance of these terms is due to:
i)    You;
ii)    A third party unconnected with the provision of the boat trip and where the failure was unforeseeable or unavoidable;
iii)    Unusual or unforeseen circumstances beyond our control, the consequences of which could not have been avoided even if all due care and attention had been exercised. 

(a)    We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors or for fraud or fraudulent misrepresentation. 
(b)    Our liability except in relation to cases involving death or personal injury shall be limited to the cost of the ticket at time of booking.

Safety onboard 

Our vessel is inspected by the Maritime and Coastguard Agency and licensed to Cat 3 to operate 20 miles from a safe haven.

How we may use your personal information

Reporting concerns
We aim to provide a good customers experience, from time of booking to the end of your boat trip. If you have any feedback of concerns, or have suggestions as to how we can improve our boat trips, please email info@coastandcleddau.co.uk 

In the event that you are dissatisfied with any aspect of your boat trip experience, please contact us on the email address above and we will endeavor to address your concerns.

In the event that a resolution cannot be reached, we will follow the Port of Milford Haven complaints procedure, a copy of which is available on request. 


General

(a)    Emails to you will be to the address you specify to us. It is important that you give us an accurate and valid e-mail address and contact telephone number and inform us immediately of any changes to them.

(b)    If a court finds part of these terms illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

(c)    Nobody else has any rights under these terms.  These terms are between you and us. No other person shall have any rights to enforce any of its terms.

(d)    Even if we delay in enforcing these terms, we can still enforce them later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking these terms, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. 

(e)    Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by Welsh and English law and you can bring legal proceedings in the Welsh and English courts.
